The main document on the issue of establishing holidays is the Labor Code of the Russian Federation. In Art. 112 of this document not only directly lists the days defined as non-working holidays for the Russian Federation, but also provides the rules:

  • transferring public days off that fall on the same date as holidays;
  • salary calculations for the month that includes holidays.

The rules for transferring public days off that fall on the same date as holidays are divided into 2 groups depending on which specific holidays they relate to:

  • forming a rest period from January 1 to January 8 (New Year holidays and Christmas) lasting more than a week, which inevitably includes 2 general days off;
  • all other celebrations of the year (February 23; March 8; May 1 and 9; June 12; November 4), each of which can fall on both a working day and a weekend.

In the first case, the transfer of 2 general days off occurs either in accordance with a specially published law of the Russian Federation, or by a decision adopted by the Government of the Russian Federation. But the transfer is always made for reasons of rationality in providing such days in a particular year. The regulatory act of the Government of the Russian Federation approving this decision is published no later than a month before the start of the corresponding year. At the same time, decisions on postponements made by the Government of the Russian Federation this year are also possible, but their publication must be carried out no later than 2 months before the day to which the day off is transferred.

In the second case, the transfer procedure follows a clearly established procedure: if a holiday and a general day off coincide, the day off moves to the next working day following the holiday.
